CarrySmart App Privacy

CarrySmart provides an emergency messaging service that allows users to send SMS text messages to designated emergency contacts when the CarrySmart application is activated. Messages may include alerts indicating an emergency situation and may include user-authorized data such as approximate location.

Android Messsages are sent via organic Android messaging services

IOS Messages are sent via Twilio’s messaging platform.

At CarrySmart, we prioritize your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and safeguard your data when you use the CarrySmart mobile application (the "App").

1. Information We Collect

When the CarrySmart App is activated, it may collect the following information based on your preferences:

  • GPS Location Data: If enabled, the App can record and transmit your real-time geographic location during an emergency event, once the application is triggered. 

  • Microphone Audio Recording: If enabled, the App can record audio from your device's microphone during activation, storing it locally on your device or initiating a phone call to a desired contact. 

  • Emergency Contact Information: To alert your designated emergency contacts, the App retains user-defined messages and phone numbers, independent of the local device contacts list. 

2. How We Use Your Information

The information collected by CarrySmart is held entirely on your end-user device and is used strictly for safety and emergency response purposes:

  • Emergency Alerts: When activated, the App may send text messages or initiate phone calls to your selected emergency contacts, sharing your location and notifying them of your situation.

  • Local Data Storage: Audio recordings are stored securely on your device and are not transmitted over a network unless you manually choose to share them.

  • User-Controlled Activation: All features are user-selectable. GPS tracking, audio recording, and messaging only occur if explicitly enabled by you.

    CarrySmart does not record or transmit any personal data, GPS location, or audio recordings to our servers or third parties without your explicit consent. All recorded data remains on your device unless you choose to share it during an emergency. Any communication (text or call) with your emergency contacts is initiated directly from your device, with no involvement from CarrySmart after call initiation.

3. USER TERMS and AGREEMENTS

A. User Consent & Permissions

By enabling Messaging Services within the app, you expressly consent to:

  • Sending SMS text messages and/or placing phone calls from your device

  • Using third-party messaging infrastructure (including Twilio)

  • Granting permissions required for messaging, location, and phone access

Permissions are requested transparently and may be revoked at any time through your device settings.

No messages are sent without explicit user action.

B. Opt In & Out (SMS Compliance)

Opt-In

Users opt in by enabling emergency messaging within the CarrySmart app and initiating an emergency alert.

Opt-Out

Recipients may opt out of receiving messages at any time by replying:

STOP

Recipients may request assistance by replying:

HELP

After opting out, no further messages will be sent unless re-initiated by the user.

C. Message Frequency

Message frequency is event-driven only and depends entirely on user activation. CarrySmart does not send recurring, automated, or promotional messages.

D. Message & Data Rates

Standard message and data rates may apply based on the recipient’s mobile carrier and plan. CarrySmart is not responsible for carrier fees.

E. Emergency Disclaimer (Apple + Twilio Requirement)

CarrySmart Messaging Services:

  • Do not automatically contact 911 or emergency services

  • Are not guaranteed to reach emergency responders

  • Should not be relied upon as the sole means of emergency assistance

Users should always contact local emergency services directly when possible.

F. Privacy & Data Handling

  • Messaging data is used solely to transmit user-initiated emergency alerts

  • Audio recordings and other sensitive data remain on the user’s device unless explicitly shared

  • CarrySmart does not sell or use messaging data for advertising

G. Service Availability

Messaging Services may be affected by:

  • Network coverage

  • Carrier limitations

  • System maintenance or outages

CarrySmart does not guarantee message delivery, timing, or availability.

H. User Responsibilities

You agree that:

  • You have permission to message the contacts you designate

  • You will not use the service for unlawful, abusive, or misleading purposes

  • You are responsible for ensuring emergency contacts understand the nature of the alerts

4. User Control and Permissions

  • You can enable or disable GPS tracking, audio recording, phone calls, and emergency contact messaging at any time from the App settings.

  • You control who receives emergency alerts and what data is shared during an alert.

5. Security Measures

We implement industry-standard security protocols to protect your data:

  • Local data is stored securely on your device.

  • Local emergency beacon devices do not transmit any personally identifiable or sensitive information across the datalink. 

  • Network communications to third parties (text or phone, if initiated by you) are protected per your telephone service's privacy policy.

6. Third-Party Access

CarrySmart does not share your data with third-party services. Any data you send to emergency contacts is directly managed by your device's native messaging and calling capabilities.

7. Children's Privacy

CarrySmart is not designed for use by children under the age of 13 without parental consent.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be reflected in the "Last Updated" date at the top of this policy.
